Terms of Service

These terms are an agreement between you and Cutdesk ("Cutdesk", "we", "us") for your use of the Cutdesk website at usecutdesk.com, the Cutdesk web app and any related services (together, the "Service"). By creating an account or using the Service you agree to these terms. If you don't agree, don't use the Service.

1. The Service

Cutdesk is an online video editor for short-form video. You upload footage, and Cutdesk's tools, Cutdesk AI or an AI agent you connect (such as Claude Code or Codex over MCP) edit it into videos you can export.

2. Accounts

• You must be at least 18 years old, or the age of majority where you live, to create an account or buy a plan.
• Give accurate account information and keep your login secure. You're responsible for everything done through your account.
• One free trial per person. Creating extra accounts to get more trials or credits isn't allowed.

3. Free trial

New accounts get a free trial of 3 days and 100 credits. No card is needed and you won't be charged when the trial ends. When the trial ends or its credits run out, your projects become read-only until you choose a paid plan.

4. Plans, billing and renewal

• Paid plans are monthly subscriptions at the price shown on our pricing page when you subscribe, in US dollars, plus any tax that applies.
• Your subscription renews automatically every month and your payment method is charged at the start of each billing period until you cancel.
• Each paid month includes the credits listed for your plan. Credits measure usage of the Service (such as footage analysis, transcription, AI editing and editing time). They have no cash value, can't be transferred or exchanged for money, and end if your account is closed.
• If you upgrade, the change takes effect right away and you're charged the prorated difference for the rest of the period. Downgrades take effect at your next renewal.
• If a payment fails we may retry it. If it still can't be collected, your projects become read-only until the balance is paid or you subscribe again.
• We may change plan prices. We'll tell you by email at least 30 days before a new price applies to your subscription, and you can cancel before it does.
• Payments are processed by Stripe. We don't store your full card details.

5. Cancellation and refunds

You can cancel at any time from your account. Cancelling stops future renewals; your plan stays active until the end of the period you've already paid for. All payments are final and non-refundable, including for partial months and unused credits, except where the law requires otherwise. See Refunds & cancellation.

6. Your content

• You keep all rights to the footage, audio, images and other material you upload and to the videos you make ("Your Content").
• You give Cutdesk permission to store, copy, process and transmit Your Content only as needed to run the Service for you, including sending it to the service providers listed in our Privacy Policy (for example, to transcribe speech or analyze footage when you ask). We don't use Your Content to advertise or sell it.
• You confirm you have the rights to everything you upload, including the consent of people who appear in it, and that Your Content doesn't break the law or anyone else's rights.

7. Acceptable use

You agree not to:

• upload content that is illegal, sexually exploits minors, infringes someone's copyright or other rights, harasses or threatens people, or is non-consensual intimate imagery;
• use the Service to make deceptive content meant to impersonate real people or mislead others in a harmful way;
• try to get around usage limits, credits or the free trial rules, or access other users' accounts or data;
• probe, attack or overload the Service, or reverse engineer it except where the law allows;
• resell or share the Service or your account without our written permission.

We may remove content or suspend accounts that break these rules.

8. AI output

Edits, captions, transcripts and other output made by AI can be wrong or incomplete. Review your videos before you publish them. You're responsible for what you publish.

9. Third-party services

If you connect your own AI agent or another service, your use of it is also governed by that provider's terms, and you pay that provider for it. We aren't responsible for third-party services.

10. Storage and deletion

Each plan has a storage limit. Deleted projects go to the trash and are permanently removed after 30 days. Keep your own copies of anything important; the Service isn't a backup service. If you close your account, we delete Your Content as described in our Privacy Policy.

11. Suspension and termination

You can stop using the Service and close your account at any time. We may suspend or end your access if you break these terms, don't pay, or if we need to for legal or security reasons. If we stop offering the Service entirely, we'll give you reasonable notice so you can export your work.

12. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, express or implied, including that the Service will be uninterrupted, error-free or fit for a particular purpose.

13. Limitation of liability

To the extent the law allows, Cutdesk won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.

14. Indemnity

You agree to cover Cutdesk's losses and costs from claims by others arising from Your Content or your breach of these terms.

15. Changes to these terms

We may update these terms. If a change is significant, we'll tell you by email or in the app before it takes effect. Continuing to use the Service after that means you accept the new terms.
